This End User License Agreement (Agreement) is between you and ExpertAnalytics Group, Inc. who governs use of the Experts Court Infinity app and website version of this app made available through the Apple App Store, Google Play Store, and via the world wide web. By installing the Experts Court Infinity App, you agree to be bound by this Agreement and understand that there is no tolerance for objectionable content. If you do not agree with the terms and conditions of this Agreement, you are not entitled to use the Experts Court Infinity App. In order to ensure ExpertAnalytics Group, Inc. provides the best experience possible for everyone, we strongly enforce a no tolerance policy for objectionable content. If you see inappropriate content, please use the "Report as Offensive" feature found under each post. 1. Parties This Agreement is between you and ExpertAnalytics Group, Inc. only, and not Apple, Inc.(Apple), or Google. Notwithstanding the foregoing, you acknowledge that Apple and Google, as well as their subsidiaries are third party beneficiaries of this Agreement and Apple and Google reserve the right to enforce this Agreement against you. ExpertAnalytics Group, Inc., not Apple and Google is solely responsible for the Experts Court Infinity App and its content. 2. Privacy ExpertAnalytics Group, Inc. may collect and use information about your usage of the Experts Court Infinity App, including certain types of information from and about your device. ExpertAnalytics Group, Inc. may use this information, as long as it is in a form that does not personally identify you, to measure the use and performance of the Experts Court Infinity App. 3. Limited License ExpertAnalytics Group, Inc. grants you a limited, non-exclusive, non-transferable, revocable license to use the Experts Court Infinity App for your personal business purposes. You may only access and use the Experts Court Infinity App on Apple, or Google devices that you own or control, and as permitted by the App Store and Google Play Store Terms of Service. You may also access and use the website version of the app online via your personal computer, or business computer.&nbsp; 4. Age Restrictions By using the Experts Court Infinity App, you represent and warrant that: (a) you are 18 years of age or older and you agree to be bound by this Agreement. (b) if you are under 18 years of age, it is not permissible for you to create an account or use this app. (c) your use of the Experts Court App does not violate any applicable law or regulation. Your access to the Experts Court App may be terminated without warning if Experts Court believes, in its sole discretion, that you are under the age of 18 years. &nbsp; 5. Objectionable Content Policy Content may not be submitted to ExpertAnalytics Group, Inc., who will moderate all content and ultimately decide whether or not to post a submission to the extent such content includes, is in conjunction with, or alongside any, Objectionable Content. Objectionable Content includes, but is not limited to: (i) sexually explicit materials. (ii) obscene, defamatory, libelous, slanderous, violent and/or unlawful content or profanity. (iii) content that infringes upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary right, or that is deceptive or fraudulent. (iv) content that promotes the use or sale of illegal or regulated substances, tobacco products, ammunition and/or firearms. (v) gambling, including without limitation, any online casino, sports books, bingo or poker. 6. Refund Policy, Guarantee, Warrant, and Subscription Hold: ExpertAnalytics Group, Inc. offers a standard 60 day money back guarantee. Should a refund be requested after the 60 days, no refund will be issued under any circumstance. We also offer a 1 time subscription hold due to unforeseen circumstances.&nbsp; We do not under any circumstances issue refunds related to an expert, or expert firm being retained for a specific number of cases and/or consulting opportunities. ExpertAnalytics Group, Inc. cannot predict when cases will be tried in any discipline. ExpertAnalytics Group does not offer refunds due to company development processes, timeline of technology development, or any other ExpertAnalytics Group, Inc. Products and/or Services. ExpertAnalytics Group, Inc. because ExpertAnalytics Group, Inc. engages in ongoing development and innovation of all company Product and Services. Expert and Expert Firm Profile Creation Requirements: New, or existing clients, are responsible for creation of their expert, legal, or insurer member profile, as a member of Experts Court. ExpertAnalytics Group, Inc. will not be responsible for delays related to profile development of expert, or expert firm members. Any assistance, that expert and expert firms receive related to profile creation is in a support capacity ONLY. Experts, or Expert Firms are required to complete the appropriate profile specs forms to be eligible for profile support. If the specs form is not completed ExpertAnalytics Group, Inc. cannot complete a profile with efficiency and accuracy throughout profile creation support. Experts and Expert Firms are required to do an independent review of the preliminary profile content that ExpertAnalytics Group, Inc. has assisted with for the benefit of the Expert, or Expert Firm. Experts and Expert Firms are required to respond to pending questions that may arise. ExpertAnalytics Group, Inc. does not engage in sole creation of profiles to ensure that profiles are legitimate and original throughout the Experts Court app. ExpertAnalytics Group, Inc. supports Experts and Expert Firms in profile creation and endeavours to create accurate profile content that is a legitimate representation of the Expert, or Expert Firm. ExpertAnalytics Group, Inc, does not issue refunds related to profile accuracy. profile creation , completion, and verification. Accuracy and legitimacy of content is the responsibility of every expert, or expert firm to confirm and to inform a profile data analyst of the changes that they require should they deem changes necessary and to ensure that the changes requested are completed to their satisfaction. ExpertAnalytics Group, Inc. also does not under any circumstances issue refunds due to company technology development, product/service innovations, acts of God, emergencies, pandemics, COVID-19, illness of staff, unintentional contractor errors, unintentional executive errors, internal staff disputes, external disputes, or any other circumstances beyond our control. ExpertAnalytics Group, Inc. may from time to time deem it appropriate to offer a conditional membership extension, or a membership credit due to technology development, or unforeseen circumstances. Subscription Termination, or Suspension: ExpertAnalytics Group, Inc. reserves the right to suspend, or cancel the subscription of any expert, or expert firm should they violate ExpertAnalytics Group, Inc. Terms of Use Policy. If a subscription is suspended, or cancelled due to violation of ExpertAnalytics Group, Inc Terms of Use Policy no credit, or refund will be issued under any circumstances. Should a subscription be cancelled by the user after the 60 day trial period no refund will be issued under any circumstances.&nbsp; Billing: Expert and Expert Firm members are billed on an annual basis. Membership fees are due in full in advance to receiving access to our platforms, tools, and resources. Membership subscriptions are auto renewed for convenience and a notification email will be send 7 days prior to the renewal period. You will also be contacted by an ExpertAnalytics Group, Inc. team member to confirm renewal. Should an expert or expert firm member not wish to move forward with renewal it is the responsibility for the expert, or expert firm to inform us within 5 days of receiving the membership renewal email. In the event that we cannot reach you and the existing member fails to respond to the renewal email and notice, the membership of the expert, or expert firm will be auto-renewed for another year. After the renewal notification and billing process occurs no refund, or credit will be available. If we cannot renew your subscription due to a billing issue, the transaction will be tried again in 3 days. If we still cannot collect payment for the subscription membership fee due then the expert, or expert firm subscription will be cancelled accordingly. If an expert, or expert firm wishes to continue their membership thereafter, they will be required to re-register as a member and pay the designated registration fee for either an expert, or expert firm. Maintenance and Technical Support: ExpertAnalytics Group, Inc. provides maintenance and technical support for the Experts Court Infinity mobile and website version but not to the extent that any maintenance or support is required by applicable law. ExpertAnalytics Group, Inc., not Apple, or Google shall be obligated to furnish any such maintenance, or technical support 8. Product Claims: ExpertAnalytics Group, Inc., not Apple, or Google is responsible for addressing any claims by you relating to the Experts Court Infinity App, or use of it, including, but not limited to: (i) any product liability claim. (ii) any claim that the Experts Court fails to conform to any applicable legal or regulatory requirement. (iii) any claim arising under consumer protection or similar legislation. Nothing in this Agreement shall be deemed an admission that you may have such claims. 9. Third Party Intellectual Property Claims: ExpertAnalytics Group, Inc. shall not be obligated to indemnify, or defend you with respect to any third party claim arising out or relating to the Experts Court Infinity App. To the extent that ExpertAnalytics Group, Inc. is required to provide indemnification by applicable law. ExpertAnalytics Group, Inc., not Apple, or Google shall be solely responsible for the investigation, defense, settlement and discharge of any claim that the Experts Court Infinity App or your use of it may infringe any third party intellectual property right.
